Report from the conference “Traffic right in land transport national and international”

As announced start with the backlog from last year. On 13.06.2014 r. in Warsaw at the University of Technology and Economics them. Helena Chodkowska was held in Warsaw conference "Transport Law in land transport national and international levels". Finally, there is an opportunity, to share with their insights from the conference.

Traffic right in the science of law is a relatively small niche, and the scientific nature of the conference made, that can hardly be expected to participate a significant number of representatives of the transport industry, many who usually put themselves at conferences organized transport m.in. by TSL Business and Transportation Manager. Hence, do not hide, that I was wondering, what will be the attendance at the conference. My fears were unfounded, because the lecture hall was quite filled, and as you can see there were students of local universities.

The conference program was quite extensive and included nine lectures and discussion on the prospects of Polish transport law. Among the topics of the presentations we have seen a clear distinction between, on the one hand, public transport law issues involving primarily administrative provisions relating to the rules, which it may be carried out transport operations and on the other hand, issues of private law concerning contractual relationship between the parties to the agreements in the transport industry.

In retrospect it can be stated, that the number of lectures on the planned duration of the conference was too high. For this reason, it was not possible to discuss long statements made by various speakers - especially in view of the many interesting questions asked of the Hall – and the conference itself ended up pretty much on time. I admit at the same time, that he is to some extent contributed about 10 minutes prolonging my lectures (Unfortunately, this was not the first time J ).

As regards the presentations of the same, This private law issues, which is I set having regard to the program, met all my expectations. Were of great representatives of the "school of Szczecin" transport law, Dr. Dorothy Ambrożuk, dr. And Dr. Daniel Dabrowski. Krzysztof Wesolowski authors of the recent commentary on transport law (will be reviewed in its time J).

Dr. Ambrożuk very synthetically presented the development of the "creeping revolution" in the field of traffic rights to carry passengers, which gradually increasing role played by the rules of the European Union, especially against strong broad interpretation of those provisions by the Court of Justice of the EU. On the other hand, Dr. Dabrowski discussed the very important topic of the law applicable to the contract of carriage multimodal, which often occurs in the international literature and jurisprudence, in Poland so far beyond the publication of the Dr.. Dabrowski did not live to see the special interest. This presentation sparked a series of questions, moreover, from the audience at the end of the first panel of the conference.

Dr. Wesolowski but gave a great lecture about the possibility of the application of tort liability of the carrier for shipping damage. This issue for a long time lying on the sidelines Polish interest doctrine, and only the most recent in last year's publication of Dr.. Szanciło can find in-depth analysis of this topic. PhD thesis. Wesolowski permitting the possibility of using the rules of tort liability of the carrier is certainly worth noting, although personally rather not share that view (as mentioned, polemic, unfortunately there was not enough time J ).

Interesting was also talk of limitations Dr.. Thomas Szanciło the author of the popular commentary on transport law and comparative legal monographs on the liability of road transport, without whose initiative the conference in general probably would not take place. Dr. Szanciło drew attention to the difficult to accept regulations in the field of transport law of limitation, which in some cases clash with common sense.

Unfortunately, it turned out, that, contrary to previous announcements individual presentations will not be issued in the form of conference publication. However, if any appears somewhere, I'll know about it.

I also hope, that the first conference of the year will spur the next meetings, especially as the increasing number of professionals involved in this topic, So there is a chance for more and more interesting discussions and numerous experiences, which may take part exchange.
