Uniform Rules concerning the Validation of Technical Standards and the Adoption of Uniform Technical Prescriptions applicable to Railway Material used in International Traffic (APTU)

Article 1.
Scope

These Uniform Rules shall determine the method of approval of technical standards and adoption of harmonized technical rules for the rolling stock designed for use in international traffic.

Article 2.
Definitions

For the purposes of these Uniform Rules and their annexes, expression:

a) "Contracting State" means any Member State of the, which has not made in accordance with Article. 42 § 1 the first sentence of the Convention, reservation on these Uniform Rules,

b) "International traffic" means the movement of railway vehicles on railway lines linking the territories of at least two Contracting States,

c) "Railway company" means any private or public, authorized to carry passengers or goods, and which provides traction,

d) "Infrastructure manager" means any establishment or any administrative body managing the railway infrastructure,

and) "Railway equipment" means any railway equipment intended for use in international traffic, in particular, railway vehicles and railway infrastructure,

f) "Railway vehicle" means any vehicle capable of moving on its own wheels on railway lines with or without traction drive,

g) "Traction" means a railway vehicle equipped with its own drive,

h) "Convertible mark" means a railway vehicle, not equipped with its own drive, designed to carry goods,

i) "Passenger car" means a railway vehicle, not equipped with its own drive, designed to carry passengers,

j) "Railway infrastructure" means all the railway lines and fixed installations, if they are necessary to ensure traffic safety and rail transport,

k) "Technical standard" means any technical specification adopted by recognized national or international standardization bodies, according to the procedure used by; Each technical specification developed within the European Union is a technical standard,

the) I) 'Technical regulation' means any principle other than a technical standard relating to the construction, Operating, maintain or procedure for dealing with railway equipment,

m) "Committee of Technical Experts" means the Commission, referred to in article 13 § 1 point f of the Convention.

Article 3.
The

§ 1. Approval of technical standards for rail equipment and the adoption of Uniform Technical Prescriptions applicable to Railway is to:

a) facilitate the free circulation of vehicles and the free use of other railway equipment in international traffic,

b) contribute to ensuring safety, reliability and suitability for international communications traffic,

c) consideration of environmental and public health.
§ 2. In approving or adopting technical standards harmonized technical standards, should be taken into account only those standards and these rules, which were developed at an international level.
§ 3. For this purpose,, as far as possible:

a) to ensure interoperability of technical systems and components necessary for international communication,

b) harmonized technical standards and technical regulations should be consistent in performance; in appropriate cases, should allow for variations.

Article 4.
Develop technical standards and regulations

§ 1. Develop technical standards and uniform technical provisions for rail equipment within the jurisdiction of bodies considered appropriate in this area.
§ 2. The standardization of industrial products and procedures within the competence of recognized national and international standards bodies.

Article 5.
Approval of the technical standards

§ 1. Applications for approval of technical standards may be submitted:

a) each Contracting State,

b) Any regional economic integration organization, which its Member States have transferred competence to the field of technical standards relating to Railway,

c) any national or international standardization body, whose task is to normalize with respect to rail,

d) each representative of the International Association, for which members of the existence of technical standards for railway equipment is necessary for reasons of safety and economy in their business.
§ 2. Committee of Technical Experts to decide on the approval of the technical standards under, referred to in Article. 16, art. 20 i art. 33 § 6 Convention. The decisions shall come into force in accordance with Article. 35 § 3 to § 4 Convention.

Article 6.
Adoption of Uniform Technical Prescriptions

§ 1. Applications for adoption of uniform technical rules may be submitted:

a) each Contracting State,

b) each regional economic integration organization, which its Member States have transferred competence to the field of technical regulations, relating to Railway,

c) each representative of the International Association, for which members of the existence of harmonized technical provisions for railway equipment is necessary for reasons of safety and economy in their business.
§ 2. Technical Experts Committee chooses to adopt a unified technical regulation in accordance with the procedure laid. 16, art. 20 i art. 33 § 6 Convention. The decisions shall come into force in accordance with Article. 35 § 3 to § 4 Convention.

Article 7.
The form requests

Conclusions, referred to in Article. 5 i art. 6 must be complete, consistent and reasonable. Applications should be sent to the Secretary General of one of its official languages.

Article 8.
Attachments

§ 1. Approved technical standards and technical regulations adopted Uniform included in the following appendices to these Uniform Rules:

a) technical standards and uniform technical rules for all rail vehicles (annex 1),

b) technical standards and uniform technical rules for traction (annex 2),

c) technical standards and uniform technical rules for freight wagons (annex 3),

d) technical standards and uniform technical provision for passenger cars (annex 4),

and) harmonized technical standards and technical regulations for the installation of infrastructure, other than those listed in subparagraph. f (annex 5),

f) technical standards and uniform technical rules for the safety of traffic as (annex 6),

g) technical standards and uniform technical rules for information technology systems (annex 7),

h) harmonized technical standards and technical regulations relating to any other railway equipment (annex 8).
§ 2. The Annexes form an integral part of these Uniform Rules. Their structure should take into account the distinct gauge, Extreme, systems of energy supply and security systems in directing traffic in the Contracting States.
§ 3. Annexes are replaced by, be adopted by the Committee of Technical Experts on the entry into force of the Protocol of 3 June 1999 years introducing amendments to the Convention, accordance with the procedure such as that provided for in Article. 16, art. 20 i art. 33 § 6 Convention concerning the amendments to the Annexes.

Article 9.
Statements

§ 1. Each Contracting State may, within four months, the date of notification by the Secretary General of the Commission decision of Technical Experts, give him a reasoned statement, which states, that it will not apply or will apply only partially approved technical standard or uniform provision in relation to railway infrastructure situated on its territory and transport infrastructure on the.
§ 2. Contracting States, that made the reservation in accordance with § 1, are not taken into account when determining the number of states, which according to Article. 35 § 4 Objections to the Convention,, causing, it does not enter into force, Commission Decision of Technical Experts.
§ 3. You, which has made a reservation in accordance with § 1, may at any time withdraw, notifying the Secretary-General. The withdrawal shall take effect the first day of second month, the date of notification.

Article 10.
Repeal of homogeneity of Technical

Following the entry into force of annexes, adopted by the Commission of Technical Experts, accordance with Article. 8 § 3 attachments, in all States Parties of the International Convention for the unity of the Railway Technical, signed at Berne on 21 October 1882 years, repeals the provisions of the Convention as amended at the 1938 years.

Article 11.
Priority attachments

§ 1. After the entry into force of annexes adopted by the Commission of Technical Experts in accordance with Article. 8 § 3, harmonized technical standards and technical regulations, contained in these annexes, prevail between the Contracting States in relation to the provisions of the International Convention for the unity of the Railway Technical, signed at Berne on 21 October 1882 years, to the wording of 1938 years.
§ 2. After the entry into force of annexes adopted by the Commission of Technical Experts in accordance with Article. 8 § 3, These Uniform Rules and the technical standards and uniform technical provisions contained in these annexes are in Contracting States priority over the technical provisions:

a) Regulations governing the reciprocal use of carriages and baggage wagons in international traffic (RIC),

b) Regulations governing the reciprocal use of wagons in international traffic (RIV).
